Plea calls for restitution to two swindling victims

James C. Somers, 56, of Roseville, pleaded guilty Tuesday in Ramsey County District Court to one count of felony theft. Somers had been charged with felony theft by swindle in two complaints. The other count will be dismissed at sentencing.

One complaint accused him of scamming an 86-year-old St. Paul man out of $25,000 for roof repairs when all he did was spray-paint the roof vents so they appeared new. That happened in May.

The other alleged that Somers persuaded a 67-year-old St. Paul woman who was showing signs of dementia to write him 11 checks totaling more than $29,000. Two of the checks had notations, one for "tree removal" for $950, the other for "garage door" for $1,800.

The plea agreement calls for Somers to make restitution to both victims. The total amount will be determined by probation officials. The agreement also calls for a stayed prison sentence and no more than 90 days in jail.

Somers will be sentenced Oct. 20 by District Judge Teresa Warner.
