The owner of Michelangelo’s Pizza in southwest Minneapolis has been charged with tax violations for allegedly failing to file income tax returns and remit sales taxes from 2004 to 2006.

The Hennepin County Attorney’s office charged Martin Davis, 38, of Minneapolis, with three gross misdemeanors and six felony tax crimes associated with the case. The Minnesota Department of Revenue estimates that Davis owes the state more than $100,000.

According to a press release from the Department of Revenue, Michelango’s — at 3002 W. 50th St. in Minneapolis — allegedly charged customers sales tax, but didn’t remit it to the state. It also says Davis received substantial income from the restaurant, but failed to report it to the state.

Davis allegedly admitted to Department of Revenue investigators that he failed to file income tax returns and he allegedly admitted to collecting sales tax but never paying it to the state because he said he couldn’t afford it.

Each gross misdemeanor carries a sentence of up to 1 year in prison, up to a $3,000 fine or both. The felony charges are punishable by up to 5-years in prison, a $10,000 fine or both.

Davis couldn’t be reached for comment.
